TERMS AND CONDITIONS

The purchaser hereby acknowledges and agrees to the following terms and conditions of sale:

Receiving:

• Customer is responsible for all freight charges on refused shipments.
• Please call Technical Support at 1-877-462-1422 before returning any products for your RMA authorization.
• All CPU/memory sales are final. CPUs/memory damaged in shipping can only be returned within 30 days of the original invoice date for credit or replacement.
• All returns must be in resalable condition and include all original documentation, packaging, and accessories as well as a copy of the original invoice. There will be a 15% restocking charge.
• Credit for returned merchandise will be based on the current selling price.
• Returned merchandise must be shipped freight prepaid. Any returns shipped freight due or without valid AustinQBC return authorization (RMA) codes will be refused.
• Defective products returned for repair after the 30-day replacement period are sent to the manufacturer for repair or replacement.
• We do not cross ship. We must receive the defective product before it is replaced.
• Merchandise returned for repair found not to be defective will be returned to the customer. A service charge of $25 will be applied to all returned shipping charges, which will be due upon receipt.
• Shipping and handling charges are not refundable.

Delivery: AustinQBC will make every reasonable effort to effect shipment on or before the estimated delivery date set forth on AustinQBCs' acknowledgment to Purchaser's order. AustinQBC is not liable for delays caused by government order, strikes, lockouts, floods, fires, explosions, earthquakes, or other causes beyond its reasonable control.

Shipment: All shipments shall be F.O.B. from AustinQBC's warehouses or manufacturing facilities or those licensed by AustinQBC. Any payment by AustinQBC of freight charges shall be for the Purchaser's account and shall not extend the obligations of AustinQBC with respect to delivery, nor shall AustinQBC be under any obligation to replace goods lost or damaged in transit. Purchaser may select the manner of shipment and the carrier. Our world wide shipping is currently made through United Parcel Service Worldwide, using next day, second day, or standard ground delivery. The customer is expected to inspect all merchandise upon receipt and report any discrepancies within one week. No claims will be made after this time. AustinQBC, however, reserves the right to make alternate arrangements if necessary to avoid substantial delay in shipment of the goods. In the absence of specific instructions in writing, AustinQBC will ship by the method it deems most appropriate.

Limitation: AustinQBC shall not be liable for damages or penalties as a result of late or lost shipment, even if AustinQBC has been notified that such damages or penalties may apply.

Payment: All goods and services are due upon receipt of the order, unless otherwise arranged in writing. Visa / Mastercard / Discover / American Express / Debit cards are accepted without surcharge. All credit cards are verified for fraudulent use by our secure site programs. Insta-Check service will be honored on your personal or business checking account, upon transfer of funds. Prices are set at the time of order, regardless of future price fluctuations.

Ownership of Merchandise: The Purchaser acknowledges that ownership of the goods remains with AustinQBC until AustinQBC has received payment for the goods in full. This retention of ownership is acknowledged and accepted by the Purchaser and supersedes any implied transfer of ownership made by delivery of the goods.

Credits: AustinQBC will not issue credit on products past the 30-day return period. AustinQBC will gladly issue a credit or money back for products, providing the customer follows the return procedure set forth above, subject to AustinQBC prior written approval. When requesting credit or money back the customer must provide proof of purchase by furnishing a copy of the AustinQBC invoice and all applicable serial numbers.

Refunds: All merchandise is subject to the above-mentioned conditions of returns.

Returns: No returns on merchandise without the inventory tags. All returned merchandise will be tested before replacement or restocking takes place. Our systems carry a 30-day money back guarantee, and our components carry a 7-day no fee return guarantee, both guarantees start three days after products are shipped. Defective merchandise, which is subject to manufacturer's warranty, may be returned to the manufacturer for repair or replacement throughout the term of the warranty. Non-defective merchandise may be returned at the option of AustinQBC only during the 30 or 7 day window. All returns past these periods will be subject to a 15% restocking fee. All returns require an original receipt and a return merchandise authorization ("RMA") number, which can be obtained by calling AustinQBCs' customer service support line. Returned items must be in the original packing material and include all parts and documents. All RMA merchandise should arrive at AustinQBC freight prepaid. All RMA merchandise subject to the applicable manufacturer's warranty will be repaired or replaced and returned to Purchaser via UPS or similar carrier, at AustinQBC's option. Purchaser may receive money back or a credit against purchases in lieu of repair or replacement.

Warranty: All warranties are null and void if the inventory tags are removed. No exceptions. There will be no warranty for physically damaged merchandise. AustinQBC has a one-year warranty on all merchandise, unless otherwise stated on invoice. Manufacture's warranties vary from one year to five years, depending on the product. Restoration and Restocking fees: AustinQBC, will charge a restoration fee, based on current market value, for all products returned for credit that are not properly shipped, subject to AustinQBC discretion. AustinQBC will charge a 20% re-stocking fee for all products refused without a 48 hour advance notice; AustinQBC. retains the right to charge a 5%-25% re-stocking or handling fee for all non-defective merchandise returns that do not comply with AustinQBC's RMA policy.

DISCLAIMER: EXCEPT AS OTHERWISE EXPRESSLY PROVIDED HEREIN, AUSTINQBC MAKES NO CLAIM, AND HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO THE PRODUCTS SOLD, WHETHER EXPRESSED, IMPLIED OR STATUTORY, WRITTEN OR VERBAL, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE. AUSTINQBC SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGE FOR LOST PROFITS, LOSS OF USE, LOST DATA OR FOR ANY DAMAGES INCURRED BY CUSTOMERS AND/OR THIRD PARTIES, EVEN IF AUSTINQBC HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY WHETHER ANY CLAIM IS BASED ON PRINCIPLES OF CONTRACT; WARRANTY, NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, INDEMNITY CONTRIBUTION, THE FAILURE OF ANY LIMITED OR EXCLUSIVE REMEDY TO ACHIEVE ITS ESSENTIAL OR INTENDED PURPOSE OR OTHERWISE. AUSTINQBC MERELY COORDINATES THE WARRANTIES OFFERED BY THE MANUFACTURER OF THE PRODUCTS SOLD AND DOES NOT ADOPT SUCH WARRANTIES, NOR DOES IT CREATE ANY ADDITIONAL WARRANTIES, NOTHING HEREIN SHALL BE CONSTRUED AS MANUFACTURER WARRANTY OR BEING LIABLE THEREUNDER.

Attorney's Fees: In the event AustinQBC incurs collections costs or institutes suit to collect any amount due under this agreement, then the Purchaser agrees to pay any and all such additional collection costs, charges and expenses, including reasonable attorney's fees and court costs.

Applicable Law: Purchaser waives personal jurisdiction and submits itself to the jurisdiction and venue of the courts (Magistrate, State or Superior) of Travis County, Texas concerning any controversy arising out of ordinary way relating to this agreement or the products or services provided hereunder. This agreement shall be governed by and in accordance with the laws of the State of Texas. Conditions are subject to change without notice.
